General Terms and Conditions NZZ Academy

1. Scope of application

The following General Terms and Conditions apply to all events held physically or online by "NZZ Academy", a brand of Neue Zürcher Zeitung AG, as well as all events held physically or online for which NZZ Academy acts as the organizer.

2. Registration

2.1 Liability

Registrations for events are made via the respective registration platform on the Internet. Registration only becomes legally binding once confirmation has been sent in writing (letter or e-mail) and the participation fees have been paid. The events are held in compliance with the applicable official requirements; all information is provided without guarantee. Changes to the timing and content of the program as well as adjustments to the permitted number of participants may be made at any time. NZZ Academy reserves the right to exclude registered guests due to capacity restrictions, reputational risks or other justified reasons.

2.2 Terms of payment

After confirmation of admission to the event, the participant is obliged to pay the tuition fee within 7 days and in any case no later than 7 days before the start of the program. The participant's admission and enrolment in the program is subject to full payment of the participation fee. The participant or company acknowledges that a place on the program is only secured once full payment has been made.

All prices are exclusive of VAT. Unless explicitly stated in the offer, all prices are exclusive of any travel, catering and accommodation costs.

2.3 Private bribery

By registering, the participant confirms that there are no legal or contractual provisions (in particular in connection with private bribery) that would prohibit him/her from participating in the event.

2.4 Conditions and requirements for participation

The participant confirms that he/she has an excellent knowledge of German and English required for participation in the program. The participant is obliged to arrive punctually at agreed dates and locations, to attend at least 80% of the program, including all lectures, sessions, workshops, practical and theoretical activities of the entire program as required by the NZZ Academy, and to contact the program manager if he/she is unable to attend any part of the program.

3. Implementation of the event

3.1 General provisions

The participant in the event acknowledges that, subject to Section 4 below, there is no right of withdrawal with regard to the completed purchase of the event ticket. The tickets purchased for the event can therefore neither be exchanged nor refunded.

By registering, the participant agrees to these GTC as well as any other safety, access and other implementation regulations issued for the relevant event and undertakes to comply with these as well as instructions from employees of NZZ Academy (or third parties commissioned by it). He/she acknowledges that he/she may be excluded from the event if he/she fails to comply with these regulations and instructions. In the event of such exclusion, no compensation or refund of the cost of the event ticket will be made. NZZ Academy reserves the right to replace announced speakers, course leaders, specialist speakers, lecturers, etc. with others and to make necessary changes to the event program while maintaining the overall character of the event. Compensation or reimbursement of the cost of the event ticket due to such changes is excluded.

3.2 Postponement of the event

If the event is postponed for any reason whatsoever, the ticket purchased is automatically valid for the postponed date. Refunds or ticket exchanges are excluded. If hotel accommodation has been booked, it may not be possible to automatically transfer the booking to the postponed date. A change to the booked hotel or the price cannot be ruled out; any additional costs must be borne by the participant.

3.3 Cancellation or termination of the event

If an event has to be interrupted or canceled due to force majeure, external influences (demonstrations, violence, threats from third parties, pandemic, epidemic, COVID-19), official event bans (federal, cantonal, municipal) or other circumstances for which NZZ Academy is not responsible, or if an event is canceled by NZZ Academy for other reasons, the following refund conditions apply:

  • Cancellation up to two months before the start of the event: 80% of the ticket price will be refunded

  • Cancellation up to one month before the start of the event: 50% of the ticket price will be refunded

  • Cancellation less than one month before the start of the event or if the event is canceled: No refund.

Cancellation or reimbursement of any hotel accommodation booked is only possible to the extent that the hotel agrees to a cancellation or provides a refund.

4. Withdrawal of the participant(s)

All reservations, registrations and bookings (event, hotel arrangements, arrival/departure, side events, evening events) are subject to the following withdrawal and cancellation conditions:

  • Cancellation up to 90 days before the start of the event: 90% refund

  • Cancellation up to 45 days before the start of the event: 50% refund

  • Cancellation up to 15 days before the start of the event: 25% refund

  • less than 15 days before the start of the event: no refund

In the case of events lasting several days, the first day of the event is deemed to be the start of the event. These withdrawal provisions also apply in the event of hindrance due to illness, accident or other reasons for which the participant is not responsible. The declaration of withdrawal must be made in writing by post or e-mail. The refund entitlement is based on the date of receipt of the written declaration of withdrawal. For Saturdays, Sundays and public holidays, the following working day shall apply. Ticket splitting and the transfer of tickets are not possible.

5. Price adjustments

NZZ Academy reserves the right to adjust prices for events and related services. These adjustments may be made in particular if there are relatively high cost increases due to market fluctuations, changes in supplier costs or other circumstances beyond the control of the organizer. Customers will be informed of such price adjustments within a reasonable period of time.

6. Data protection

NZZ Academy attaches great importance to data protection. Personal data is treated as strictly confidential and is used exclusively for the organization of the event in question. Insofar as the booked services are not provided by NZZ Academy itself (e.g. hotel accommodation, providers of platforms for digital events), NZZ Academy is entitled to pass on the personal data to its partners for the provision of the services (further use of the contact data is subject to the partner's data protection guidelines). Furthermore, the data protection provisions apply.

7. Intellectual property

All rights to the products created or used in the context of the NZZ Academy events remain the full property of the NZZ Academy. This includes, but is not limited to, all course materials, presentations, written documentation, software, digital content and other creative works created or used in connection with the events. All materials made available to participants as part of the event also remain the property of the NZZ Academy. The redistribution, reproduction, publication or other use of these materials by participants or third parties is strictly prohibited without the prior written consent of the NZZ Academy.

8. Confidentiality

The NZZ Academy will maintain the confidentiality of all confidential information it obtains from Participants in the course of conducting the Program. Participants shall not disclose or divulge to any other person, or use or exploit for any purpose, any confidential information of any other Participant, and all Participants shall use their best efforts to prevent their employees, affiliates or agents from doing so.

9. Multimedia recordings

During the event, images, audio and/or video recordings may be made by NZZ Academy or by third parties commissioned by NZZ Academy. These recordings will be used by NZZ Academy for its own marketing purposes, among other things, on the Internet, in publications, in social networks and at events organized or run by NZZ Academy. By participating in an event, the participant agrees to the aforementioned image, sound and/or video recordings. He/she expressly allows NZZ Academy to use these for subsequent advertising purposes without any further claims by the participant. NZZ Academy reserves the right to restrict image, audio and/or video recordings by participants during the event.

10. Disclaimer

NZZ Academy's liability for direct and indirect damages as well as consequential damages incurred by the participant in connection with the organization and implementation of an event is excluded to the extent permitted by law. In particular, NZZ Academy is not liable for damages or consequential damages caused by event cancellations, interruptions or inadequate organization. In any case, liability for all contractual, tortious or other claims is limited to the cost of the event ticket. Further damages of any kind will not be compensated. Any claims for damages and other claims by the participant(s) for payment of a sum of money shall lapse within one year of their discovery.

11. Applicable law and place of jurisdiction

The services of NZZ Academy, the events it organizes and these provisions are subject exclusively to Swiss law. Any disputes arising between the participant and NZZ Academy concerning or in connection with an event shall be settled by negotiation if possible. If this is not possible, the ordinary courts in Zurich shall have exclusive jurisdiction
